Items offered through this Website are only available for delivery to residents in Vietnam.
HOW PURCHASE CONTRACTS ARE FORMED
No contract (“Contract”) in respect of the purchase of a product offered on the Site shall exist between you and us until your order has been accepted by us and we send you the Shipment Confirmation (defined below). If we do not accept your order and funds have already been deducted from your account, the funds will be fully refunded.
AVAILABILITY OF PRODUCTS
All orders for products are subject to availability and in this regard, in the event of supply difficulties or because products are no longer in stock, we reserve the right to give you information about substitute products which you can order. If you do not wish to order such substitute products, we will refund any monies that you might have paid.
PRICE AND PAYMENT
The price of the products shall be the one quoted from time to time on our Website, except where there is an apparent error. While we take care to ensure that all prices quoted on our website are accurate, errors may occur. If we discover an error in the price of any product(s) you have ordered, we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or canceling it. If we are unable to contact you, the order will be treated as canceled and if you have already paid for the product(s) you will receive a full refund. Once you have finished shopping, all the items you wish to purchase are added to your basket. Your next step will be to go through the checkout process and make payment. To do this:

Our liability in connection with any product purchased through our website is strictly limited to the purchase price of that product. We publish information on this Site as a convenience to you. While we attempt to provide accurate and timely information, there may be inadvertent technical or factual inaccuracies and typographical errors. We reserve the right to make corrections and changes to the Site at any time without notice. The products described in the Site may not be available in your region. Except as otherwise provided on the site or in these Terms, you may not use, download, upload, copy, print, display, perform, reproduce, publish, modify, delete, add to, license, post, transmit, or distribute any Materials from this Site in whole or in part, for any public or commercial purpose without the specific prior written permission of BAKES. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.
PAYMENT, ORDERING, AVAILABILITY, AND BILLING
You agree to provide accurate and up-to-date payment information at the time you order any Product. We have contracted with a third-party payment processor to facilitate purchases made on the Site. When you make a purchase through the Site, you will provide your payment details and any additional information required to complete your order directly to our third-party payment processor. You should be aware that online payment transactions are subject to validation checks by our payment processor and your card issuer, and we are not responsible if your card issuer declines to authorize payment for any reason. For your protection, our payment processor uses various fraud prevention protocols and industry standard verification systems to reduce fraud and you authorize it to verify and authenticate your payment information. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.
You agree to have sufficient funds or credit available upon placement of any such order to ensure that the purchase price will be collectible by us. After you place your order, we will send you a confirmation email (the “Order Confirmation”). We strive to provide accurate pricing information regarding the Products available on the Site. We cannot, however, insure against pricing errors. We reserve the right, at our sole discretion, to not process or to cancel any orders placed for a Product whose price was incorrectly posted on the Site as a result of an error. If this occurs, we will notify you by email.
The Site may contain information regarding the availability of Products. In rare cases, a Product may be in stock when you place the order and sold out by the time we attempt to process the order. Should this happen, we will notify you by email and cancel the item from your order or offer you to switch to another product with the same price.
Unless otherwise specified, prices quoted are exclusive of: (a) the costs of shipping or carriage to the agreed place of delivery; and (b) value added tax must be added to the price payable. You agree to pay for taxes, shipping or carriage of the Products as such costs are specified by us when you submit your order.
Delivery
- Your order will be fulfilled once we have confirmed with you the delivery time and date. If we cannot contact you, your order might be delayed and canceled.
- Your order will be delivered to the delivery address that you specify when placing your order. If we are unable to deliver to your delivery address, for example if your delivery address is geographically remote, we will notify you before we accept your order. We reserve the right not to deliver to a location too far away that might affect the quality of the products. If you wish to deliver to many different addresses, the shipping fee will be different to reflect the cost of multiple location shipments.
- The Product(s) ordered will be at your risk from the time you receive the Product(s). Ownership of the Product(s) ordered will also pass to you upon your receipt of the Product(s), provided full payment of all sums due in respect of the Product(s), including any delivery charges, has been received.
- If you believe a Product was delivered damaged or faulty or has developed a fault, you should inform us as soon as you receive it, preferably in writing, giving your name, address and order reference. We would replace it or refund it for you. We will ask you to return the cake to us as proof of damage.
Returns and Exchanges
- We do not accept Products for returns and exchanges once they have been delivered unless there’s a proof of delivery damage. After we receive your written request, we will respond with further instructions about returning the Product(s) to us.
- Upon receiving the returned Product(s) from you, we will process any refund or replacement due to you as soon as possible. You will be refunded in full to your original form of payment, including the cost of standard delivery.

SHIPPING POLICY
General
Delivery will be made to the address specified by you when you place your order. We offer free delivery for orders over VND 2.000.000 within 1km.
Our delivery time is from 9am to 8pm. We will inform and get your confirmation if there is any change in delivery time.
Our fresh baked products can only be delivered within Ho Chi Minh City area including District 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, Thu Duc, Tan Binh, Phu Nhuan, Go Vap, Binh Tan, Binh Chanh.
Shipping Outside Vietnam
We do not presently ship to destinations outside Vietnam as food products are often problematic with Customs regulations.
CANCELLATIONS, RETURN & REFUNDS
Return
Unfortunately, we don't accept perishable products to be returned. All items from www.bakes-saigon.com are sold on a non-returnable basis unless defective.
Please check that all items received are what you have ordered. If you have received an INCORRECT item DO NOT OPEN IT. We will not accept any returns or provide refunds of items that have been opened, tampered with or not in their original condition.
We do our best to minimize product breakage in transit; however, cakes can experience some breakage during shipping. If you receive your product damaged or contaminated in any way, please contact us directly and we will do our best to resolve the issue.
Please DO NOT return any food product without contacting us first for specific information regarding the return process.
Cancellations
If customer choose DELIVERY:
Delivery: Please call our hotline to check your order status and cancel your order immediately. Please be noted that we only accept cancellation before your selected delivery time of 120 minutes.
If customer choose PICK UP:
Pick up: Please call our hotline to check your order status and cancel your order immediately.
For customized orders, cancellation won’t be accepted.
Refunds
A refund will only be considered for orders which are accepted to be cancelled by Bakes Saigon. We reserve the right to deny a refund without proof of purchase or a bank statement/credit card statement can help us hopefully.
All requests of refund will be processed within 5 working days, excluding Saturday, Sunday, and Public Holidays.
We cannot refund a product already purchased.
Payment terms
1. Cash on delivery (COD):
Customer pays for goods at the time of delivery.
This payment method does not apply to high-value orders or customized order.

Note:
Use credit/debit/prepaid cards VISA, MasterCard issued by domestic and international banks.
To pay by credit card, international card, transaction must be successfully recorded from the successful licensing notice returned by the payment gateway system (ensuring balance / limit and customer authentication according to card usage rules).
Additional charges in addition to the order please check carefully with the bank of the customer to avoid extra charges unintendedly.
However, in some cases you use a card that is not issued in Vietnam, you may have to pay a currency exchange fee to the issuing bank. If you are unsure about this fee, please contact the card issuing bank for further advice.
We currently do not support payment by card after receiving goods.
